Consumer Health Data Privacy Policy
Consumer Health Data Privacy Policy
Last updated: October 22, 2026
This policy explains how Fit for the Magic, LLC (“we,” “us,” or “our”) collects, uses, and shares consumer health data. It is written to meet Washington’s My Health My Data Act, Nevada’s consumer health data law (SB 370), and similar laws. We apply it to every coaching client and prospective client, wherever you live. For our general privacy practices, see our Privacy Policy.
“Consumer health data” means personal information that is linked or reasonably linkable to you and identifies your past, present, or future physical or mental health.
1. Consumer health data we collect
- Injuries, pain (location, intensity, and what makes it better or worse), surgeries, and medical conditions you tell us about
- Medications or treatments you choose to share
- Fitness and activity information, such as step counts, workout logs, running history, and energy and fatigue levels
- Body measurements and physical abilities, such as balance, strength, and mobility test results
- Photos and videos of you exercising or moving
- Notes from video check-ins and messages that describe your health or progress
- Health-related goals and concerns, such as wanting to walk a full park day without knee pain
2. Why we collect it
We collect and use consumer health data only to:
- Decide whether our coaching is a good fit for you during a discovery call
- Build, deliver, and adjust your personalized strength or run coaching program
- Track your progress and communicate with you about it
- Keep accurate records of the coaching we provided
We collect consumer health data only with your consent, which we ask for before your discovery call or intake. We never use it for advertising, and we never sell it.
3. Where we get it
- Directly from you: booking forms, intake forms, workout logs, messages, emails, texts, and video check-ins
- From fitness apps or devices, only if you choose to share that data with us
- From a referral partner, only if you’ve asked them to share it with us
4. Who we share it with
We share consumer health data only with service providers (called “processors” under these laws) who store or process it for us under contract and only on our instructions. We don’t share it with any third party for their own use. Our processors are:
- Google Workspace: email, video check-ins, and document storage
- TrueCoach: training programs and workout logs
- Calendly: booking forms for discovery calls and check-ins
- DocuSign: signed coaching agreements
- Circle: our online community, only for what you choose to post there
- Meta Platforms (Instagram and Facebook Messenger): only for direct messages you choose to send us there
- AI assistants: help drafting programs and summarizing notes, using settings that don’t train AI models on your data where available
We may also disclose consumer health data if the law requires it, such as in response to a valid court order.
5. Your rights
You have the right to:
- Confirm and access: find out whether we collect, share, or sell your consumer health data, get a copy of it, and get a list of every third party and affiliate we’ve shared it with, including their contact information
- Withdraw consent: stop us from collecting or sharing your consumer health data going forward
- Delete: have us delete your consumer health data. We’ll also tell our processors to delete it. Data in backups is deleted within 6 months.
- Appeal: ask us to reconsider if we deny your request
We won’t treat you differently for using these rights. If you withdraw consent or ask us to delete your data, we may not be able to keep coaching you, since your program depends on that information.
6. How to make a request
Email stephen.cabebe@gmail.com with the subject line “Health Data Request” and tell us what you’d like us to do. We’ll verify your identity, usually by replying to the email address we have on file, and respond within 45 days. If we need more time, we’ll tell you why and may take up to 45 more days.
Appeals: if we deny your request, reply to our response with the subject line “Appeal” within 60 days. We’ll respond in writing within 45 days and explain our decision. If your appeal is denied, you can contact the Washington State Attorney General or the Nevada Attorney General, or the attorney general where you live.
