Fit for the Magic Privacy Policy

Privacy Policy
Last updated: October 22, 2026
This policy explains how Fit for the Magic, LLC (“Fit for the Magic,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information. It covers http://www.fitforthemagic.com, our email newsletter, our online shop, the Happily Ever Active podcast pages, and our 1-on-1 strength and run coaching services.
If you live in Washington or Nevada, or you’re a coaching client anywhere, please also read our Consumer Health Data Privacy Policy, which covers the health-related information we collect in more detail.
The short version
- We collect what you give us (like your name, email, and, if you become a client, information about your health, injuries, and fitness) plus some technical data from your visit.
- We use it to run the website, send the emails you signed up for, sell our products, and coach you.
- We don’t sell your personal information for money. We use the Meta Pixel to measure and show ads, and you can opt out of that.
- Health information you share as a client is used only to coach you. It’s never used for advertising.
- You can ask to see, correct, or delete your information at any time by emailing stephen.cabebe@gmail.com.
1. Our coaching is not physical therapy
Stephen Cabebe, the founder of Fit for the Magic, is a licensed Doctor of Physical Therapy. However, the services offered through Fit for the Magic are strength and run coaching, not physical therapy or medical care. We don’t bill health insurance, and we are not a “covered entity” under the Health Insurance Portability and Accountability Act (HIPAA). That means HIPAA doesn’t apply to the information you share with us. We still treat your health information as sensitive and protect it as described in this policy and our Consumer Health Data Privacy Policy.
2. Information we collect
Information you give us
- Contact and newsletter sign-ups: your name, email address, and anything you write in a message to us.
- Blog comments: your name, email address, website (optional), and your comment. Comments and your name are public.
- Purchases: your name, email, billing and shipping address, phone number (if provided), and order details. Payment card details are entered directly with our payment processor. We never see or store your full card number.
- Discovery calls: your name, contact details, and the answers you give when booking a call, such as your trip plans, goals, and any pain or injuries you mention.
- Coaching clients: information you share during intake and throughout coaching, including your health and injury history, pain levels, activity levels, medications or conditions you choose to tell us about, training logs, goals, trip details, photos or videos of you exercising, notes from video check-ins, messages by email, DM, or text, and your signed coaching agreement.
- Community and podcast: if you join our online community, what you post there. If you’re a podcast guest, your name, bio, photo, and the recording of your conversation.
Information collected automatically
- Site analytics: we use Jetpack Stats (from Automattic, the company behind WordPress.com) to see how many people visit and which pages they view. It collects data such as your IP address, browser type, device type, referring page, and pages viewed.
- Meta Pixel: a piece of code from Meta Platforms that tells us when someone who saw our ad on Facebook or Instagram visits our site or takes an action like signing up or buying. Meta may use this data to show you our ads and to improve its own ad services.
- Cookies: small files stored by your browser. Our site uses cookies to keep your shopping cart working, remember comment details if you choose, and support the analytics and advertising tools above.
- Comment data: when you leave a comment, we collect your IP address and browser information to help detect spam.
Information from other sources
We may receive information about you from payment processors (confirmation that a payment went through), scheduling and e-signature tools, referral partners who introduce you to us with your permission, and social media platforms when you message or interact with our accounts.
3. How we use your information
- To run, maintain, and improve the website and shop
- To process orders, deliver products, and handle refunds
- To send the newsletter, free guides, and other emails you signed up for
- To answer your questions and hold discovery calls
- To deliver 1-on-1 coaching: building your program, tracking your progress, adjusting your plan, and communicating with you between check-ins
- To measure how our website and ads perform and show ads to people who may be interested
- To share client stories, only with your written permission (see Section 6)
- To keep records for taxes, accounting, and legal reasons
- To protect the site and our business from spam, fraud, and misuse
4. Who we share your information with
We share personal information only with the companies that help us run the business, and only what each one needs to do its job. These companies handle your information under their own privacy policies.

We may also share information:
- When the law requires it, such as in response to a valid subpoena or court order, or to protect someone’s safety.
- If the business changes hands, such as a merger or sale, in which case the new owner would have to protect your information as this policy describes.
- With your permission, for any other reason you agree to.
Books sold elsewhere: if you buy Disney Ready through Amazon or Lulu, that purchase happens on their site and is covered by their privacy policies, not ours.
5. How we use AI tools
We sometimes use AI assistants to help us draft training programs, summarize check-in notes, and write messages. When we do, we limit what we share to what the task needs. We use tools and settings that don’t use your information to train their AI models whenever that option is available. Every program and message is reviewed by Stephen before it reaches you. AI is never used to make decisions about you on its own.
6. Client stories and testimonials
We’ll only share your name, photo, video, quote, or story publicly if you give us written permission first. You can change your mind at any time by emailing us, and we’ll remove your story from our website and social accounts going forward. We can’t pull back posts that others have already shared or copies that have been saved by others.
7. Advertising, cookies, and your choices
We don’t sell your personal information for money. We do use the Meta Pixel, which shares information about your activity on our site with Meta so we can measure and target our ads. Some state laws treat this as “sharing” or “targeted advertising.” We never use health information you give us as a coaching client for advertising.
Here’s how to limit tracking:
- Opt out with us: email stephen.cabebe@gmail.com with the subject “Do Not Share” and we’ll exclude you from our ad tracking and ad audiences where we can.
- Meta settings: manage ad preferences in your Facebook or Instagram account under Accounts Center, then “Ad preferences.”
- Browser settings: block or delete cookies in your browser. Some parts of the site, like the shopping cart, may not work without them.
- Industry tools: visit optout.aboutads.info or, in the EU and UK, youronlinechoices.eu.
8. Emails and text messages
You can unsubscribe from our emails at any time using the link at the bottom of any message. We may still send you messages about orders or active coaching.
If you’re a coaching client, we may text you to check in and support your program. Message and data rates may apply. Reply STOP to stop texts at any time. We don’t share your mobile number or text message opt-in with anyone for their own marketing.
9. How long we keep your information
- Coaching records (intake, health and injury history, programs, check-in notes, and messages): 7 years after your last session, then deleted.
- Purchase and payment records: 7 years, for tax purposes.
- Newsletter subscribers: until you unsubscribe. We keep your email on a “do not send” list afterward so we don’t email you by mistake.
- Discovery call and contact form details (if you don’t become a client): up to 2 years.
- Blog comments: until you ask us to remove them or we remove the post.
- Site analytics: as long as Jetpack and Meta keep it under their own policies.
We may keep information longer if the law requires it or to resolve a dispute.
10. How we protect your information
We use password-protected accounts with two-factor authentication where available, choose reputable service providers, and limit access to client information to Stephen and anyone working for us who needs it. No system is perfectly secure, so we can’t guarantee absolute security. If a breach affects your personal information, we’ll notify you as the law requires.
11. Your rights
No matter where you live, you can ask us to:
- Tell you what personal information we have about you and give you a copy
- Correct information that’s wrong
- Delete your information
- Stop using your information for marketing or targeted ads
- Withdraw any permission you’ve given us, such as for a testimonial
Email stephen.cabebe@gmail.com with your request. We’ll confirm your identity, usually by replying to the email address we have on file, and respond within 45 days. You can have an authorized agent make a request for you if you give them written permission. We won’t treat you differently for using any of these rights. If we can’t do what you ask (for example, because we must keep tax records), we’ll explain why, and you can reply to appeal our decision. Residents of some states can also contact their state attorney general if they disagree with the result of an appeal.
If you’re in the EU, EEA, UK, or Switzerland
Fit for the Magic, LLC is the controller of your personal information. We rely on these legal bases:
- Contract: to deliver coaching and products you’ve purchased
- Consent: for newsletter emails, cookies and the Meta Pixel, testimonials, and health information you share as a client
- Legitimate interests: to run and protect the website, answer messages, and improve our services
- Legal obligation: to keep tax and accounting records
You also have the right to data portability, to object to or restrict certain processing, and to complain to your local data protection authority. Our business and service providers are based in the United States, so your information is processed there. Where required, our service providers use approved safeguards such as Standard Contractual Clauses or the EU-U.S. Data Privacy Framework.
12. Children
Our website and services are for adults 18 and older. We don’t knowingly collect personal information from anyone under 18. If you think a child has given us their information, email us and we’ll delete it.
13. Links to other websites
Our site links to other sites, including Amazon, Lulu, Spotify, Apple Podcasts, YouTube, and Instagram. We aren’t responsible for their privacy practices, so please read their policies.
14. Changes to this policy
We may update this policy as our business or the law changes. We’ll post the new version here with a new “Last updated” date. If we make a major change to how we use your information, we’ll tell you by email or with a notice on the site.
